Moving Company Owner Sentenced

Regular readers will know that for many reasons we continually advise consumers to stay well away from moving company brokers. In a June 2013 post we pointed out that moving company brokers Moving.com and 123Movers were actively recommending a rogue moving company – Mr. Move.

Mugshot of Dunwoodie McDuffie owner and operator of Mr. MoveLast week a press release from the Department of Justice, U.S. Attorney’s Office, Eastern District of Louisiana announced that Dunwoodie McDuffie owner and operator of Mr. Move, was sentenced on eight counts of conducting interstate household goods moves without the proper Department of Transportation authorities.

Court documents show that in May 2007 Mr. Move applied for a USDOT number and Household Goods (HHG) operating authority from the Federal Motor Carrier Safety Administration (FMCsA). After receiving a DOT number, Mr. Move failed a safety audit that is required within 18 months of receiving a number. Additionally, Mr. Move failed to submit information needed to obtain HHG operating authority. Consequentially, Mr. Move was not granted authority and its DOT number was revoked in December 2008.

In May 2012 the Louisiana State Police and the FMCSA conducted a compliance review and found Mr. Move had continued to do business regardless of being placed out of service and was operating without authority. Also Mr. Move had failed to file a Motor Carrier Identification Report and was using drivers that did not possess a valid operator’s license.

In August 2012 a further compliance review discovered similar violations and found that Mr. Move had conducted 17 interstate HHG moves without operating authority and a DOT number. Federal prosecutors charged McDuffie with eight counts of operating without a DOT number and without HHG authority.

McDuffie pleaded guilty to all eight counts and was sentenced to six months incarceration, 50 hours of community service and 12 months of supervised released.
